March 24, (Press ki Taquat)-According to Section 8(3) of the Representation of the People (RP) Act, 1951, which guides the disqualification of an MLA, the moment a Member of Parliament is convicted of an offense Convicted and given a minimum sentence of two years, he or she attracts disqualification. Mr. Gandhi is the second member of Parliament to be disqualified in recent times. Lakshdeep MP, PP Mohammad Faisal, who was convicted by a court in Lakshadweep in January, was disqualified. The Law Ministry has recommended the Kerala High Court to suspend the conviction, saying his disqualification as a member of the Lok Sabha will no longer be valid.
