Chandigarh, July 12 (Ozi news desk): Following the implementation of the new laws, the Punjab and Haryana High Court has made it clear that individuals can still file fresh cases and applications under the laws that have been repealed. This decision, announced by Chief Justice Sheel Nagu shortly after his promotion, aims to ensure a smooth transition between the old and new legal systems, allowing for uninterrupted access to justice without any procedural obstacles.
The order specifically mentions the new laws, namely ‘Bharatiya Nyaya Sanhita, 2023’, ‘Bharatiya Nagarik Suraksha Sanhita, 2023’, and ‘Bharatiya Sakshya Adhiniyam, 2023’, which came into effect on July 1. It highlights that cases and applications can be filed in the high court under either the provisions of the newly enacted laws or the laws that have been repealed, such as the Indian Penal Code, 1860; Code of Criminal Procedure, 1973; and Indian Evidence Act, 1872.
To alleviate any concerns, the High Court has explicitly instructed the High Court Registry not to raise any objections to the filing of cases under either the new laws or the old laws. This move aims to provide clarity and assurance to individuals seeking justice during this transitional period, ensuring that legal proceedings can continue smoothly and without unnecessary complications.
